Terms of Service

1. Preamble and publisher identification
These Terms of Service (hereinafter the "Terms") govern access to and use of the BROODZ online game website and service, available at https://broodz.com (hereinafter the "Site" or the "Service").
The Site and the Service are published by:

Accessing the Service implies full and unreserved acceptance of these Terms.
2. Definitions
In these Terms, the following terms have the meaning set out below:
- "Publisher": Coredump Engineering, the company publishing the Service.
- "Service": the BROODZ online multiplayer game and all features accessible from the Site.
- "User": any natural person who accesses the Site or uses the Service, whether logged into an Account or not.
- "Account": the personal space created by the User through authentication with a third-party identity provider (Google, Facebook, Snapchat or TikTok). The Account is identified by the pair formed of the chosen provider and the stable identifier that provider transmits.
- "Service Content": all elements making up the Service (code, game engine, universe, creatures and lineages, artwork, trademarks, logos, texts, interfaces, sounds).
3. Purpose
These Terms define the conditions under which the User accesses and uses the Service, as well as the respective rights and obligations of the Publisher and the User. They form the contract applicable between the Publisher and the User in respect of the use of the Service.
BROODZ is an online multiplayer puzzle game playable directly in the browser, in which several players compete on a shared grid. The Service is provided free of charge.
4. Acceptance and enforceability of the Terms
Use of the Service is subject to prior and unreserved acceptance of these Terms. By accessing the Service, creating an Account or using it, the User acknowledges having read and fully accepted the Terms.
If the User does not accept the Terms, the User must refrain from accessing and using the Service.
5. Access to the Service and eligibility
5.1 Technical access conditions
Access to the Service requires an Internet connection and a compatible web browser. Connection and equipment costs remain the sole responsibility of the User.
5.2 Minimum age
The Service is reserved for persons aged at least 13 years. By using the Service, the User represents and warrants that they are at least 13 years old.
A User who is a minor aged 13 or over but who has not reached the legal age of majority represents and warrants that they have obtained the prior authorization of their holder(s) of parental authority or legal representative to use the Service and to accept these Terms. The Publisher reserves the right to suspend or close any Account that it has reasonable grounds to believe is held by a person under 13 years of age.
6. User account and authentication
6.1 Account creation
An Account is created through authentication with a third-party identity provider. As of the date of these Terms, four providers are in service: Google, Facebook, Snapchat and TikTok. The Service offers no account creation with an email address and a password.
When authenticating with a provider, the Publisher receives from that provider a limited set of data necessary to create and manage the Account: the account name and a stable provider-specific identifier. Google, Snapchat and TikTok transmit no email address (the permissions requested do not cover it); Facebook may transmit one where the User grants that permission, but the Publisher does not retain it. The processing of this data is described in Article 10 and in the Privacy Policy.
6.2 Account identification
The Account is identified by the pair formed of the identity provider and the stable identifier that provider transmits. No email address is attached to, collected by or verified by the Publisher, and no feature of the Service is conditional on such a verification: creating a match, joining a match and appearing on the leaderboards are open from the first sign-in.
The Account is accessed by signing in again with the same identity provider.
6.3 Accuracy and security
The Publisher holds no password of the User: authentication takes place entirely at the chosen
identity provider, and the Publisher never receives the User's credentials for that provider. The
User's session is maintained by means of a functional session cookie (__Host-brood_session),
strictly necessary for the operation of the Service.
The User undertakes to provide accurate information and to maintain the security of the third-party account used to log in. The User is responsible for all activity carried out from their Account. The User undertakes to inform the Publisher without delay, at contact@broodz.com, of any unauthorized use of their Account.
6.4 Uniqueness
One third-party account (provider and identifier) may be attached to only one Account. Each User undertakes to hold only one Account and not to create multiple accounts, in particular for the purpose of distorting rankings or circumventing a suspension measure.
6.5 Account deletion
The User may delete their Account at any time directly from the Service, via the profile page. Deletion of the Account results in the erasure of the associated data under the conditions described in the Privacy Policy and subject to legal retention obligations.
7. Description of the Service and free access
The Service allows the User to take part in multiplayer games, choose a display name ("username"), record scores and appear in rankings ("leaderboards").
The Service is provided free of charge. The Publisher reserves the right to develop, modify, add to or remove all or part of the Service's features at any time and without notice, in particular for technical, security or product reasons.
8. Acceptable use rules
The User undertakes to use the Service fairly, in accordance with its purpose, these Terms and applicable regulations. In particular, the User is prohibited from, without this list being exhaustive:
- using bots, scripts, automation, cheating devices or any technical means intended to gain an unfair advantage, distort the course of a game, or manipulate scores and rankings;
- disrupting, slowing down or compromising the operation, integrity or security of the Service, servers or networks, in particular through any attack or overload;
- attempting to gain unauthorized access to accounts, systems or data, or carrying out automated extraction ("scraping") of the Service;
- choosing or displaying a username or content that is unlawful, insulting, defamatory, hateful, discriminatory, violent, pornographic, or that infringes the rights of third parties;
- harassing, threatening or harming other Users;
- impersonating a third party or passing themselves off as the Publisher;
- decompiling, disassembling or reverse-engineering the Service, except within the limits permitted by law;
- reproducing, representing, distributing or commercially exploiting all or part of the Service Content without authorization.
Failure to comply with these rules may result in the measures provided for in Article 12.
9. Intellectual property
All Service Content, including in particular the code, game engine, universe, creatures and lineages, artwork, interfaces, texts, sounds, as well as the "BROODZ" trademarks, names and logos, is and remains the exclusive property of the Publisher or its licensors, and is protected by intellectual property law.
The Publisher grants the User a personal, non-exclusive, non-assignable and non-transferable right to use the Service, for strictly personal and non-commercial purposes, for the duration of use of the Service. Any other use, and in particular any reproduction, representation, adaptation, modification or exploitation, in whole or in part, of the Service Content, without the prior written authorization of the Publisher, is prohibited and constitutes infringement.
The username chosen by the User remains under the User's responsibility. By entering it, the User grants the Publisher the right to display it as part of the Service (games, rankings) for the purposes of operating the Service.
10. Personal data and cookies
The Publisher processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 as amended ("Informatique et Libertés").
10.1 Data processed
As part of the Service, the Publisher processes in particular:
- data transmitted by the authentication provider (account name and stable provider-specific identifier);
- game data (username, scores, leaderboard rank);
- a strictly necessary session cookie (
__Host-brood_session) for the operation of the Service.
10.2 Recipients and processors
Data may be disclosed to the following providers, acting as processors or recipients: OVH (hosting, within the European Union) and the login providers in service, Google, Facebook, Snapchat and TikTok (authentication).
10.3 Audience measurement
The Publisher measures usage of the Service through a self-hosted Matomo instance, configured without cookies and without cross-site tracking. This setup falls within the consent exemption recognised by the CNIL for audience measurement: it sets no cookie and does not require the User's consent, though the User may object to it by writing to dpo@broodz.com. Details are set out in the Privacy Policy and the Cookie Policy.
10.4 Data subject rights
In accordance with applicable regulations, the User has rights of access, rectification, erasure, restriction, objection and portability with respect to their data, as well as the right to define directives regarding its fate after their death. These rights may be exercised at dpo@broodz.com. The User also has the right to lodge a complaint with the French data protection authority (Commission nationale de l'informatique et des libertés, CNIL).

11. Availability of the Service and maintenance
The Publisher endeavors to keep the Service accessible, but is not subject to any obligation of result in this respect. As the Service is provided free of charge, the Publisher does not guarantee continuous, uninterrupted or error-free access.
The Publisher may, at any time and without notice, suspend, interrupt or limit access to all or part of the Service, in particular for maintenance, updates, security, or in the event of a technical constraint. The Publisher cannot be held liable for the consequences of such unavailability.
The Service also depends on third-party services (in particular the authentication provider and the host), the availability of which the Publisher does not control.
12. Liability and warranties
12.1 "As is" provision
The Service is provided "as is" and "as available". To the extent permitted by law, and given that the Service is free of charge, the Publisher provides no warranty, express or implied, as to the availability, continuity, reliability, absence of errors or fitness of the Service for a particular purpose.
12.2 Limitation of liability
To the extent permitted by law, the Publisher cannot be held liable for indirect damages, nor for loss resulting in particular from: unavailability or malfunction of the Service; loss of data or scores; fraudulent use of an Account attributable to the User or a third party; failure of third-party services (authentication, hosting, Internet network); or an event of force majeure within the meaning of Article 1218 of the French Civil Code and case law.
12.3 User liability
The User is solely responsible for their use of the Service and for compliance with these Terms. The User indemnifies the Publisher against any third-party claim resulting from a breach on their part.
12.4 Mandatory protective provisions
The provisions of this Article apply without prejudice to the rights that the User, as a consumer, derives from mandatory legal provisions, in particular the French Consumer Code and the French Civil Code, from which no derogation is possible.
13. Suspension and termination
The User may stop using the Service and delete their Account at any time, from the profile page.
The Publisher may, without prejudice to any other rights, suspend or close, temporarily or permanently, a User's access to the Service and/or their Account, in the event of a breach of these Terms, fraudulent, abusive or unlawful use of the Service, or infringement of the rights of third parties or of the Publisher. Where circumstances permit, the Publisher endeavors to inform the User.
The cessation of use of the Service, for whatever reason, does not affect the provisions which, by their nature, are intended to survive (in particular those relating to intellectual property, liability and applicable law).
14. Amendment of the Terms
The Publisher reserves the right to amend these Terms at any time, in particular to take account of changes to the Service or to regulations. The applicable version is the one in force and accessible on the Site at the time of access to the Service. The last-updated date appears at the top of this document.
In the event of a substantial change, the Publisher endeavors to inform the User by an appropriate means. Continued use of the Service after the amended Terms come into force constitutes acceptance of them.
15. Applicable law and dispute resolution
15.1 Applicable law
These Terms are governed by French law.
15.2 Amicable settlement
In the event of a dispute, the User is invited to contact the Publisher first at contact@broodz.com in order to seek an amicable solution.
15.3 Competent courts
Failing an amicable resolution, any dispute relating to the formation, interpretation, performance or validity of these Terms shall be submitted to the competent French courts. It is recalled that the User, as a consumer, retains the benefit of the protective rules of jurisdiction provided for by law, and may in particular bring proceedings, at their choice, before the court of the place where they resided at the time the contract was concluded or at which the harmful event occurred.

17. Miscellaneous provisions
- Entire agreement. These Terms, together with the Privacy Policy, express the entire agreement between the User and the Publisher in respect of the Service.
- Severability. If any provision of these Terms is declared void or unenforceable, the remaining provisions shall retain their full force and effect.
- No waiver. The Publisher's failure to invoke a provision does not constitute a waiver of its right to invoke it subsequently.
- Language. These Terms are drafted in French. This English translation is provided for convenience; in the event of any discrepancy, the French version prevails.
